Erika D. Hart won an appeal before the Michigan Court of Appeals regarding whether a real estate associate or salesperson is an independent contractor under Michigan law. In affirming the Macomb County Circuit Court, the Court of Appeals held that MCLA Section 339.2501(h) defined the relationship between appellant real estate salesperson and the company real estate broker as an independent contractor relationship. Further, the Court of Appeals held, in its first published opinion on the issue, that public policy in Michigan does not allow an independent contractor to bring a wrongful termination or wrongful discharge claim.
