With almost 20 years of experience, Erika Hart practices in the areas of insolvency, estate planning, probate and business law. Erika is Board Certified in Consumer Bankruptcy by the American Board of Certification and has annually completed Michigan’s estate planning program through the Institute of Continued Legal Education since 2014.

Erika’s specific niche exists where these areas of practice come together – representing business owners and their struggling enterprise through negotiations and workout with lenders and creditors, business winddown or reorganization, as needed and appropriate – depending on the unique and specific needs of each client.

Experience:

Representation of individuals and families with estate and asset protection planning, including revocable and irrevocable trusts, special needs trusts, addressing the transition of personal and business assets between generations and business partners.

Representation of fiduciaries and beneficiaries following death with all aspects of the administration of estate and trusts, including trust administration, probate, and intestate estates.

Advises closely held businesses and their owners in a broad range of legal matters, including formation, succession planning and transactions.

Representation of business owners and their struggling enterprises through negotiations and workout with lenders and creditors, business winddown or reorganization. Representation of professionals, personal guarantors, real estate companies, manufacturers and small business owners in examining personal and corporate obligations, asset exposure and protection, and resolution. Negotiation of settlement, forbearance, offer in compromise and other resolutions with the SBA, national banks, and other secured creditors and lessors.

Advise and represent clients in state and federal litigation matters, including bankruptcy court, federal district courts, 6th Circuit Court of Appeals and Michigan Court of Appeals.

Erika has been designated a Super Lawyer and one of the Top Women Attorneys in Michigan for the last several years.
